Terms of Service

1. Acceptance of Terms

By accessing or using Giive.ai ("Giive," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our platform. These terms apply to all users including nonprofit organizations, donors, and visitors.

2. Description of Service

Giive is a zero-fee fundraising platform that enables nonprofit organizations to sell event tickets and collect donations. Giive processes payments on behalf of nonprofits via Stripe Connect. The platform sustains itself through optional, voluntary tips from donors at checkout.

3. Eligibility — Nonprofit Organizations

To register as an Organization on Giive, you must:

• Be a registered nonprofit, tax-exempt organization, school group, sports team, or other legitimate fundraising entity
• Have authority to enter into these Terms on behalf of your organization
• Connect a valid Stripe account to receive payouts
• Provide accurate and complete organization information

Giive reserves the right to deny or terminate accounts for organizations that misrepresent their status or engage in fraudulent fundraising.

4. Payment Processing & Fees

For Nonprofits: Giive charges no platform fees. 100% of ticket and donation proceeds are transferred to your connected Stripe account. Stripe's standard payment processing fees are covered by Giive from optional donor tips.

For Donors: At checkout, donors are presented with an optional tip to support Giive's operations. Tip options are 8.25%, 20%, 40%, a custom amount, or $0. Tips are entirely voluntary. Selecting $0 does not reduce the amount received by the nonprofit. The tip amount is separate from and in addition to the ticket or donation price.

Payouts: Funds are paid out to connected Stripe accounts according to Stripe's payout schedule, typically within 2-7 business days.

5. Refund Policy

Refund policies are set by each individual nonprofit organization. Giive does not guarantee refunds. Donors seeking refunds should contact the nonprofit organization directly. In cases of fraud or unauthorized charges, contact us at support@giive.ai.

6. Employer Matching

Giive provides employer matching information as a convenience feature based on publicly available data. Giive does not guarantee the accuracy of matching program information, match eligibility, or that any employer will fulfill a matching commitment. Donors are responsible for verifying matching eligibility with their employer.

7. Tax Receipts

Giive sends automated email receipts for all transactions. Tax deductibility of donations depends on the nonprofit organization's tax-exempt status. Giive does not provide tax advice. Donors should consult a tax professional regarding deductibility.

8. Prohibited Uses

You may not use Giive to:

• Conduct fraudulent fundraising or misrepresent your organization
• Collect funds for illegal activities
• Violate any applicable laws or regulations
• Harass, abuse, or harm any person
• Distribute malware or attempt to compromise platform security
• Use the platform for personal enrichment unrelated to a legitimate charitable cause

9. Intellectual Property

All content, features, and functionality of Giive — including logos, design, code, and text — are owned by Giive.ai and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

By uploading event photos or content to Giive, you grant us a non-exclusive license to display that content on our platform for the purpose of operating your event page.

10. Limitation of Liability

To the maximum extent permitted by law, Giive shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to lost donations, failed transactions, or data loss. Our total liability to you shall not exceed the amount of fees paid to Giive in the 12 months preceding the claim (which for nonprofits is $0).

11. Disclaimers

Giive is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or that the platform will meet your specific requirements. We are not responsible for actions taken by nonprofit organizations or the use of funds raised through our platform.

12. Termination

We reserve the right to suspend or terminate any account at our discretion for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. Upon termination, any pending payouts will be processed according to Stripe's standard procedures.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Texas.

14. Changes to Terms

We may update these Terms at any time. We will notify registered organizations via email of material changes. Continued use of the platform after changes constitutes acceptance of the updated terms.
